A 19-year-old Tunkhannock man was sentenced last Wednesday in Wyoming County Court to 15-60 months in state prison for access device fraud.

Dustin James Mooers appeared before President Judge Russell Shurtleff, and was told he also faces $2,943 in restitution and a $1,000 fine.

According to court records, Mooers used another’s Community Bank debit card last June 7 without their authorization.

Mooers’ defense attorney Jair Novajosky said his teen client had been in an adult prison the past five months and “was not a kid anymore.”

He said Mooers, who had an extensive juvenile record, had never been in prison before and “it has served as a wakeup call.”

Mooers addressed the judge and admitted he was in the wrong for what he had done.

“I just want to turn myself around and make something better of my life,” he said.

Novajosky noted that restitution could be paid in full within two weeks and he pleaded for the lower end of the standard range guideline.

Wyoming County District Attorney Jeff Mitchell, however, asked the judge to consider Mooers’ past criminal history as a juvenile.

Judge Shurtleff opted for a stiffer sentence in the aggravated range, he said, because Mooers made 62 attempts to defraud the victim’s debit card, and “any lesser of a sentence would depreciate the seriousness of the crime.”

OTHER SENTENCES

Other persons sentenced in the Wyoming County Court of Common Pleas by President Judge Russell Shurtleff on Wednesday, Jan. 14:

*John Edward Barral, 27, of Tunkhannock, was sentenced to 141 days-12 months in county jail and a $500 fine for theft by unlawful taking on May 3, 2014.

*Glenn Franklin Brewer, 70, of Tunkhannock, was sentenced to a period of five years of standard intermediate punishment commencing with 90 days house arrest and a $1,500 fine for DUI on Feb. 8, 2014; and to 12 months probation and a $1,000 fine for fleeing or attempting to elude officer on Feb. 8, 2014, with sentences to be served concurrently.

*Kelly L. Brown, 34, of Kingsley, was sentenced to 1-6 months in county jail and a $500 fine for DUI on Nov. 17, 2013.

*Damon Michael Dotter, 18, of Meshoppen, was sentenced to 11-23.5 months in county jail and a $500 fine for burglary on Sept. 16, 2014.

*Lynn Marie Evans, 41, of Meshoppen, was sentenced to 12 months probation and a $500 fine for theft by unlawful taking on March 17, 2014.

*Timothy James Farley, 49, of Towanda, was sentenced to six months probation for DUI on June 21, 2014.

*Donald Frantz, 58, of Copley, was sentenced to 794-1588 days in state prison and a $500 fine for possessing the instruments of crime on April 1, 2007.

*Joseph Luis Grescavage, 33, of Plymouth, was sentenced to 12 months probation and a $500 fine to criminal solicitation to possess a controlled substance on Aug. 1, 2014; and to 12 months probation, $5 restitution and a $500 fine for conspiracy to possess a controlled substance on Aug. 1, 2014, with sentences to be served concurrently.

*Courtney Lynn Gruver, 24, of Tunkhannock, was sentenced to 12-24 months in state prison and a $500 fine for theft by unlawful taking on April 22, 2014; to 12 months probation for forgery on Jan. 17, 2014, with sentences to be served concurrently; and to 9-36 months in state prison and a $500 fine for criminal trespass on April 23, 2014, with latter sentence to be served consecutive to others; but all sentences suspend so can be placed in two years of drug treatment court.

*Randy Allan Herman Jr., 22, of Laceyville, was sentenced to 30 days-6 months in county jail and a $750 fine for DUI on May 3.

*Jonathan Lee Hollister, 38, of Meshoppen, was sentenced to 4-12 months in county jail and a $500 fine for false identification to law enforcement on May 11, 2014.

*Brian Allen Howe, 38, of Shavertown, was sentenced to 12-24 months in state prison, $1,410.49 in restitution and a $500 fine for simple assault on May 10, 2014; and to 3-6 months in state prison, and a $1,000 fine for DUI on May 10, 2014; with sentences to be served consecutively.

*Allyson Noel Jordan, 25, of Tunkhannock, was sentenced to 12 months probation and a $500 fine for possession of drug paraphernalia on April 8, 2014.

*Teddie Patrick Kelley Jr., 25, of Tunkhannock, was sentenced to 2-6 months in county jail and a $1,000 fine for DUI on Sept. 21, 2014.

*Eric Joseph Matylewicz, 27, of Carbondale, was sentenced to 1-12 months in county jail and a $500 fine for theft by unlawful taking on July3, 2014.

*Christine A. McClain, 48, of Mehoopany, was sentenced to 98 days-18 months in county jail and a $1,000 fine for theft by unlawful taking on Aug. 8, 2014.

*Brandon Philip Ropraz, 19, of Tunkhannock, was sentenced to 11-23 months in county jail, a $500 fine, and a share of $94,329 in restitution for conspiracy to commit burglary on Nov. 1, 2013; and to 1-12 months in county jail and a $500 fine for theft by unlawful taking on Nov. 15, 2013, with sentences to be served concurrently.

*Dennis Hugh Smith Jr., 35, of Forkston, was sentenced to 3-6 months in county jail, restitution of $250, and a $1,500 fine for DUI of a controlled substance on Feb. 12, 2014.

*Renee E. Spindler, 26, of Factoryville, was sentenced to a $300 fine for possession of drug paraphernalia on June 23, 2014.

*Allen Harry Weber, 45, of Dallas, was sentenced to 12 months probation and a $500 fine for stalking on June 22, 2013.
